The Explainable Broker shows the reasoning behind employee benefits decisions. It does not turn a public article, email, form, or meeting request into an individualized professional engagement.

Using the site

These terms set the boundary.

These Terms of Use apply when you visit The Explainable Broker, subscribe to The Readout, read or comment on an issue, submit a case, or use a link to schedule time. By using the site, you agree to these terms. If you do not agree, please do not use the site.

Information, not advice

The examples are a starting point, not your answer.

Articles, emails, frameworks, synthetic cases, calculations, and other materials are provided for general informational and educational purposes. They may simplify facts or use assumptions to make a decision pattern visible. They are not a substitute for an analysis of your plan, contracts, workforce, claims, or applicable law.

Nothing on the site is medical, legal, tax, accounting, actuarial, investment, financial, or individualized insurance advice. Before acting, evaluate the actual facts and consult the appropriately qualified professionals for your situation.

No automatic relationship

A conversation is not an engagement.

Reading, subscribing, commenting, submitting a case, sending an email, or scheduling time does not create a broker, consultant, adviser, client, fiduciary, or other professional relationship with Scott Iwanowski, The Explainable Broker, or The Mahoney Group. Any professional relationship, scope of work, and compensation must be established in a separate written agreement signed by the relevant parties.

Case submissions

Keep the question general.

Do not submit protected health information (PHI), claimant details, diagnoses, member-level facts, identifying information, confidential employer files, trade secrets, or material you do not have the right to share. You are responsible for the information you submit.

A case submission is for consideration only. It is not a promise of analysis, publication, response, or professional service, and it should not be used to meet a deadline. The permission choice on the form controls whether an anonymized version may be considered for publication. “Private only” means the submission should not be published.

If a situation cannot be explained without sensitive or confidential details, schedule a conversation first. Do not place those details in the public comment area or the case form.

Original content

Share the idea without taking the work.

Unless otherwise noted, original articles, newsletters, graphics, frameworks, examples, and site design are owned by or licensed to The Explainable Broker and are protected by applicable intellectual property laws.

You may link to the work and share short excerpts for personal, educational, or internal business discussion when you clearly credit The Explainable Broker and link to the original. You may not republish substantial portions, remove attribution, sell or repackage the material, or use it to create a competing publication without prior written permission, except where the law allows otherwise.

Acceptable use

Use the site like a real room with real people.

  • Do not interfere with the site, forms, security controls, or another person’s access.
  • Do not use automated requests, scraping, or bulk activity in a way that burdens the service or circumvents controls.
  • Do not impersonate another person or submit unlawful, deceptive, abusive, infringing, or malicious material.
  • Do not post PHI, claimant facts, confidential employer information, or personal data that should not be public.

Access, comments, or submissions may be removed or limited when reasonably necessary to protect people, the site, or the integrity of the discussion.

Third-party services and links

Some parts of the path belong to someone else.

Beehiiv, Airtable, Cal.com, Cloudflare, and Resend help operate the website, subscriptions, case intake, scheduling, security, and operational alerts. The site may also link to research, social platforms, and other outside resources. Those services have their own terms and privacy practices, and The Explainable Broker does not control their availability, content, or security.

Disclaimers and limits

The work shows its limits. The site has limits, too.

The site and its content are provided “as is” and “as available.” The goal is careful, useful work, but completeness, accuracy, timeliness, uninterrupted availability, and a particular outcome are not guaranteed. Benefits rules, prices, contracts, and circumstances can change, and a general example can age quickly.

To the extent permitted by law, The Explainable Broker and Scott Iwanowski are not responsible for losses caused by relying on general site content as individualized advice, by information a user submits, or by outages and actions of third-party services. Nothing in these terms excludes a right or responsibility that cannot lawfully be excluded.

Governing law

Arizona is the home jurisdiction.

These terms are governed by the laws of the State of Arizona, without regard to conflict-of-law rules. Any dispute relating to these terms or the site will be brought in the state or federal courts located in Arizona, unless applicable law requires otherwise. If part of these terms is unenforceable, the remaining provisions continue to apply.

Changes to these terms

The current version lives here.

These terms may be updated as the site or its services change. The date below will change when a revised version is posted. Continued use after an update means the revised terms apply from that point forward.
